WEINGARTEN RIGHTS:

Under the U.S. Supreme court decision in the case of NLRB v. J. Weingarten, Inc., you have the right to the presence of a union representative during any "investigatory interview," but you have to ask for a union representative to be present. Dowling College does not have to offer that option. You also have no way to tell when a conversation starts whether or not it is an "investigatory interview". THEREFORE, YOU MAY WANT TO START YOUR CONVERSATION WITH AN ADMINISTRATOR BY GIVING THEM A WEINGARTEN NOTICE:

"If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working condition, I respectfully request that my union representative, officer, or steward be present at the meeting. Without representation, I choose not to answer any questions."
